I. Terms and Conditions

§ 1 Basic provisions

(1) The following terms and conditions apply to all contracts you conclude with us as a provider (CalmRise) via the website https://calmrise.es. Unless otherwise agreed, the inclusion of any of your own terms and conditions is hereby rejected.

(2) A consumer within the meaning of these provisions is any natural person who concludes a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activity. An entrepreneur is any natural or legal person, or a partnership with legal capacity, who, when concluding a legal transaction, acts in the exercise of their self-employed professional or commercial activity.

§ 2 Conclusion of the contract

(1) The subject of the contract is the sale of goods.

(2) By placing the relevant product on our website, we make you a binding offer to conclude a contract under the conditions described in the item description.

(3) The contract is concluded via the online shopping cart system as follows: The goods intended for purchase are placed in the "shopping cart". You can call up the shopping cart at any time via the corresponding button in the navigation bar and make changes. After opening the "Checkout" page and entering your personal data as well as the payment and shipping terms, all order details are displayed on the order summary page. If you use an instant payment system (such as PayPal) as your payment method, you will first be directed to the website of the instant payment provider. After that, you will be returned to our online shop, where you can give a final review of your order. By submitting the order via the "buy" button, you declare your legally binding acceptance of the offer.

(4) Order processing and the transmission of all information required to conclude the contract take place by email. Please ensure that the email address you have provided is correct and that you can receive our emails.

§ 3 Payment methods

(1) Payment by invoice via Klarna. In cooperation with Klarna, we offer payment on account. The payment term is 14 days from the invoice date. The invoice is sent by email when the goods are shipped, or together with the goods. Payment is made to Klarna.

§ 4 Right of retention and retention of title

(1) You can only exercise a right of retention insofar as it concerns claims arising from the same contractual relationship.

(2) The goods remain our property until the full purchase price has been paid.

§ 5 Warranty

(1) The statutory liability for defects applies.

(2) As a consumer, you are asked to inspect the goods immediately upon delivery for completeness, visible defects and transport damage. If you fail to do so, this has no effect on your statutory warranty claims.

§ 6 Choice of law

(1) Dutch law applies. For consumers, this choice of law only applies insofar as it does not deprive them of the protection afforded by the mandatory provisions of the law of the country of the consumer's habitual residence.

(2) The provisions of the UN Convention on Contracts for the International Sale of Goods expressly do not apply.
